‘My terminally ill dad’s life insurance won’t pay in case he takes too long to die’

Deeply unimpressed with Legal & General, I implored it to do something to help your family, but it stood its ground. I wanted to explore whether this clause was made clear to your parents when they first bought the policy. Legal & General insists that the paragraph in question is clearly stated in the policy’s terms and conditions. Having read the terms myself, I agree, this is an undeniable fact.

Next I wanted to know whether your parents had bought this life insurance by themselves or through a financial adviser. It transpired they bought it via a mortgage adviser back in 2014. This is important, because it means any complaint about the policy’s suitability would fall to them, rather than Legal & General.

Your parents should both have been made aware of this nasty terminal illness clause, yet your mother says she did not know it existed. Of course you have not yet asked your father, as he is still in hospital. In the meantime, I have advised your mother to raise a complaint with the adviser who sold the policy. You will let me know how this goes.

When and how you break this news to your father is up to you and your mother, but judging by the sensitive manner in which you’ve handled this so far, I know you’ll do the right thing.

Your days left with your father are sadly numbered, but strangely this presents a blessing. You can use this time to tell him how special he is and to say goodbye. Not everyone gets this chance, so whatever you do, don’t let the pesky issue of money get in the way. Make every second count.
